Terms of Use.
What you agree to by using this website - in plain words. These terms cover twinmind.au itself: the pages, the demos, the booking widget and the AI assistant. They are not the contract for work we do for you (section 09), and they do not touch your rights under the Australian Consumer Law (section 16). How we handle your information is a separate document - our Privacy Policy.
01Who we are
This website is operated by TwinMind (Sergii Diatchenko trading as TwinMind), ABN 83 665 668 690, based in Brisbane, Queensland, Australia. We build custom AI and automation systems for Australian businesses.
In these terms, "we", "us" and "our" mean TwinMind. "You" means anyone who uses this website - reading a page, opening a demo, talking to the assistant or booking a meeting. Our contact details are in section 23.
02What these terms cover
These terms apply to the public website twinmind.au (including www.twinmind.au) and everything we run on it: the pages and articles, the cost calculator, the booking widget, the AI assistant with its chat, microphone and call buttons, and the demo widgets embedded in our project pages.
They also apply to our other subdomains when you are given access to them - lab.twinmind.au, projects.twinmind.au, meet.twinmind.au and phone.twinmind.au - except where we have given you a separate written agreement for one, in which case that agreement wins.
Using this site means you accept these terms. If you do not accept them, please do not use the site. If you are using it for a business, you are confirming you are allowed to accept these terms on that business's behalf.
This site is built for people in business. It is not aimed at children, and we ask that you do not send us information about anyone under 16.
03What this site is - and what it is not
This is a marketing website. It exists to show what we build, let you try a few things, and make it easy to start a conversation with us.
Nothing on it is an offer capable of acceptance, and nothing you can click here forms a contract for us to do work. Prices, timelines, scopes and capabilities described on these pages are indicative. The cost calculator produces an estimate for orientation, not a quote. A binding arrangement between us only ever exists when it is written down and agreed by both of us - see section 09.
04The AI assistant, chat and voice
Every page carries an assistant you can type to, speak to, or ask to call you. It is worth being precise about what it is, because it looks like a person and is not one.
- Its answers are generated by AI models and can be wrong, incomplete or out of date, even when they sound certain. Treat what it says as a starting point for a conversation with us, not as a fact you can act on. Anything that matters - a number, a capability, a price, a date - is only real once a person at TwinMind confirms it in writing.
- A founder may join the thread and answer in person, and conversations reach us. What is kept, for how long and who else sees it is set out in our Privacy Policy.
- Please do not send it confidential material. No passwords or system credentials, no client lists, no financial records, no third party's personal information, and nothing you are contractually bound to keep secret. If a project needs real data, that is arranged separately under a written agreement - never through this panel.
- The microphone only listens when you press it, and what you say is transcribed by a third-party provider named in the Privacy Policy. Do not record other people through it without their consent - in some Australian states that is an offence, and it is your call to make, not ours.
- It is not a support channel for a live system we built you, and it is not monitored around the clock. If something of yours is broken, use the channel we agreed with you.
- We can limit or withdraw it. It is offered as-is, with no promise it will be available, and we may rate-limit, suspend or block use of it - particularly the abuse described in section 10.
Short version: the assistant is a helpful, fast, occasionally wrong colleague who has just started. Ask it anything. Verify anything you would act on.
05Nothing here is professional advice
We are engineers. We build software that moves numbers and documents around; we are not accountants, bookkeepers, tax agents, financial advisers, lawyers or migration agents. We are not registered with the Tax Practitioners Board, we do not provide tax agent or BAS services, we hold no Australian Financial Services Licence, and we are not registered migration agents.
So nothing on this website - a page, an article, a case study, the calculator, a demo or the assistant - is tax, accounting, financial, legal or migration advice, and none of it takes your circumstances into account. It is general information about what automation can do. Before you act on anything you read here, check it with your own qualified adviser.
Where we build a system that produces numbers - a reconciliation, a cost calculation, an invoice check, a report - the system is a tool for the people who are accountable for those numbers. It does not replace their review, their sign-off or their professional obligations, and our pages describe it that way on purpose.
06Demos, sample data and gated areas
The interactive widgets on our project pages, and the demos on lab.twinmind.au, exist to show a mechanism. They run on invented or anonymised data. Nothing in them is a real client's information, and no figure inside one is a statement about a real business.
They are demonstrations, not products: they can change or disappear without notice, they are not backed by any availability promise, and anything you type into one is not a record we keep for you. Do not put real business data into a demo.
Some areas need a login we hand out individually. Access is a courtesy, personal to the person we gave it to, and we can withdraw it at any time.
07Case studies, numbers and results
The figures on this site come from real projects and are stated as we measured them, for that client, with that client's data, systems and people. Some clients are named with their permission; others are described without naming them.
They are a record of what happened there. They are not a forecast, a benchmark or a promise of what you would get - your systems, your data quality and your team are different, and so the result would be. Where a number is an estimate or a projection rather than a measurement, we say so next to it.
08Booking a meeting, and the paid audit
The first meeting is free. Booking one reserves a time in our calendar - that is all it is. It does not commit either of us to anything, and either of us can move or cancel it. Please tell us if you cannot make it, so the slot goes back on offer to someone else.
The audit is paid work - A$2,000. Before you pay anything, we confirm in writing what it covers, what you receive at the end and when it is payable. If you go on to commission a build from us, the audit fee is credited in full against that build. That written confirmation governs the audit, not this page; if the two ever disagree, the written confirmation wins. We invoice and are paid by bank transfer - this website takes no card payments and stores no payment details.
If we cannot deliver an audit you have already paid for, you get your money back. Nothing in this section limits your rights under the Australian Consumer Law (section 16).
09What these terms do not cover
These terms govern this website. They are deliberately not the contract for work we do for you.
When we build something, that project runs under its own written agreement - scope, price, timeline, who owns what, confidentiality, data handling, support and the liability terms that go with a paid engagement. Where that agreement and this page disagree about the work, the agreement wins. Where you are a client using this public website, both apply: the agreement to the work, this page to the site.
10Acceptable use
Use the site for what it is for: to learn about us, try the demos and get in touch. Please do not:
- break any law with it, or use it to send anything unlawful, misleading, defamatory or abusive;
- interfere with the site or the systems behind it - no attempts to overload, disrupt or gain access you were not given, and no security testing of our live systems without asking us first (ask, and we will usually say yes - see section 15);
- impersonate someone else, or book meetings or start conversations under a false identity;
- upload anything harmful, or try to make the assistant produce something harmful, or use it to generate spam or bulk content;
- harvest personal information, email addresses or phone numbers from the site;
- copy the site, its content or its demos into a product or service that competes with ours - see section 12.
About automated access: we deliberately welcome well-behaved crawlers, including AI ones - see /robots.txt and /llms.txt, which say what is open. That permission is to read, index and summarise our pages with attribution. It is not permission to scrape the site wholesale, hammer it, ignore what those files say, or reproduce our content as your own.
11What you send us
You keep ownership of whatever you send us through this site - the notes in a booking, a file dropped into the chat, a message. By sending it, you confirm you are entitled to send it, and you give us permission to use it for the obvious purpose: to read it, reply to you, prepare for our meeting and, if we end up working together, do the work. Our Privacy Policy says how it is handled and how long it is kept.
Please keep the rule from section 04: no credentials, no confidential documents, no other person's personal information, and none of the sensitive information the Privacy Act defines. If something arrives that we should not have, we will delete it.
If you send us an idea, a suggestion or feedback about our site or products, we may use it freely and without owing you anything for it. That is not us taking your business ideas - it is so a "your chat window should do X" note does not become a licensing question.
12Our content and brand
The text, images, page designs, diagrams, code and demos on this site are ours (or used with permission) and are protected by copyright. TwinMind is our business name and our mark.
You may read, download and print pages for your own business purposes, share links freely, and quote a short extract with attribution and a link back. Feed it to an AI assistant to summarise for you if that is how you read - that is fine by us.
Please do not republish our pages wholesale, sell them, present them as your own work, strip our name off them, or reuse our content, structure or demos to build or market a competing service. If you would like to use something more substantially, ask us - the answer is often yes.
13Other people's services and links
Parts of this site hand you over to services we do not control - a video meeting on Google Meet or Microsoft Teams, a phone or video call carried by our telephony provider, a profile on LinkedIn, a page we link to because it is worth reading. Once you are there, that provider's own terms and privacy policy apply, and we are not responsible for them or for what they do.
A link from us is not an endorsement, and we cannot promise a third-party site is accurate, safe or still there.
14Availability and changes
We try to keep the site up and correct, but it is a marketing website and it comes with no uptime promise. We may change, move, gate or remove any page, demo or feature at any time, and we may take the site down for maintenance without notice. Content is accurate as at the day it was written; we are not obliged to keep every page updated forever.
15Security and logins
Where we have given you a login for a gated area, it is personal to you: keep it to yourself, and tell us straight away if you think someone else has it. We may reset or revoke access if we think it is being misused.
If you find a security problem - on this site or in anything of ours - please tell us, at sergey@twinmind.au. We would much rather hear it from you than find out the hard way, and we will not go after anyone who reports a genuine issue in good faith and gives us a fair chance to fix it before making it public. What we do ask is that you report first and do not run destructive tests, access other people's data or degrade the service while you are looking.
16Your Australian Consumer Law rights
Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy you have under the Australian Consumer Law or any other law that cannot lawfully be excluded.
Where the law implies a guarantee that cannot be excluded but allows our liability for breaching it to be limited, our liability is limited - at our option - to supplying the services again, or paying the cost of having them supplied again.
17Warranties and liability
Subject to section 16, this website, its demos and its assistant are provided "as is". We do not warrant that the site will be uninterrupted or error-free, that the assistant's answers will be accurate, or that the site is free of anything harmful, and we exclude all warranties the law does not force upon us.
Subject to section 16, and to the extent the law permits:
- we are not liable for any indirect or consequential loss, or for loss of profit, revenue, opportunity, goodwill or data, however it arises;
- we are not liable for anything you do, or do not do, on the strength of something you read on this site or were told by the assistant - that is what section 05 is there to make clear;
- our total liability for everything connected with this website is limited to A$500, or the amount you have paid us in connection with this website in the 12 months before the claim, whichever is greater;
- our liability is reduced to the extent your own act, omission or breach of these terms caused the loss.
Liability for work we do under a written agreement is dealt with in that agreement, not here.
18Indemnity
If you break these terms or use this site unlawfully, and that causes a claim against us or a loss to us, you agree to cover us for it - limited to what your own act or omission actually caused. This is not aimed at ordinary visitors; it is here for the rare case of someone using our site to harm someone else.
19Privacy
Everything about personal information - what this site collects, why, who receives it, where it is stored, how long it is kept, and how to make us delete it - lives in our Privacy Policy, which forms part of these terms. It also carries a form that suppresses your address and erases your chat history on the spot.
20Email we send you
If we email you, every message carries a working unsubscribe link and says who it is from, as the Spam Act 2003 (Cth) requires. Use it and we stop - permanently, not for 90 days. Our Privacy Policy explains how we got your address in the first place and how to have it erased as well as suppressed.
21Changes to these terms
We may update these terms as the site changes. The version and date at the top of this page always say which version is current, and the current version is the one that applies to your use of the site from the day it is published. If a change is significant, we will make it obvious rather than quietly swap the text.
22Governing law and the small print
These terms are governed by the laws of Queensland, Australia, and you and we submit to the non-exclusive jurisdiction of the courts of Queensland and the courts that hear appeals from them.
- If part of this fails - if any provision turns out to be unenforceable, it is severed and the rest keeps working.
- Not enforcing something is not giving it up - if we do not act on a breach straight away, we have not waived our rights.
- The whole agreement about the site - these terms and the Privacy Policy are the entire agreement between us about your use of this website, and replace anything said before it. Work we do for you is governed by its own written agreement (section 09).
- Assignment - we may transfer these terms to a company or entity that takes over this business; your rights are not reduced by that.
